Terms of Use
Effective date: 25 October 2026
These terms are an agreement between you and Vykka LLC, Bellevue, Washington, USA ("Vykka", "we", "us"), the publisher of the Storiwick app ("the app") and the storiwick.com website. By downloading or using the app, you agree to these terms. If you don't agree, please don't use the app.
1. Who can use Storiwick
You must be at least 13 years old to use the app. If you are under 18, or under the age of majority where you live, a parent or guardian must agree to these terms for you.
2. What Storiwick is
Storiwick helps you learn Spanish by reading and listening to short stories. It has no account and no sign-in. Your progress is kept on your phone (see the Privacy Policy at storiwick.com/privacy).
The app is free to download. All of its current features are free. If we later offer paid features, such as a subscription, we will tell you the price, the billing period and how renewal and cancellation work before you buy anything, and we will update these terms first. Purchases would be made through Google Play or the App Store under their terms. Nothing you already have will start costing money without your agreement.
3. Your licence to use the app
We give you a personal, non-exclusive, non-transferable, revocable licence to use the app on devices you own or control, for your own non-commercial learning, under these terms and the rules of the store you got it from.
You agree not to:
- copy, sell, publish or redistribute the app, its stories, audio, translations or other content, except for brief quotes for review or personal study;
- reverse engineer, decompile or change the app, except where the law allows it despite this restriction;
- use the app or its content to train or build an AI model or a competing product;
- interfere with the app, the website or the servers that deliver stories, or try to get around their security;
- use the app in a way that breaks the law.
4. Our content
The app, its stories, audio, translations, design and the Storiwick name belong to Vykka or its licensors, and are protected by law. These terms do not give you any rights in them beyond the licence above. The open-source software in the app is listed, with its licences, under Settings → Licences; those licences govern that software.
5. AI-made stories and accuracy
The stories and their audio are made with AI tools and checked before they're added to the app. We work hard to make every story, translation and recording correct and natural, but language is subtle, and some mistakes may get through. Storiwick is a learning aid. It is not a certified course, an exam preparation or a professional translation, and it does not promise a particular result, such as reaching a level by a date.
If you spot a mistake, please tell us at hello@storiwick.com. Fixing it helps every learner.
6. Your progress and backups
Your progress lives only on your phone. Whether it survives a new phone, a reinstall or a reset depends on your phone's own backup, as explained on our Support page (storiwick.com/support). Reset all progress in Settings erases it and cannot be undone. Because we never receive your progress, we cannot restore it for you, so please keep your phone's backup turned on if you want to keep it.
7. Test versions
If we give you a test version of the app before or outside its public release, it may have bugs, missing stories or features that change, and we may stop it or ask you to move to the store version at any time. Please don't share a test version with others.
8. Feedback
If you send us suggestions or reports, we may use them to improve Storiwick without owing you anything. We will treat your email as described in the Privacy Policy.
9. Changes and availability
We may update, change or stop parts of the app, add or retire stories, or stop offering the app. We may update these terms. If a change is significant, we will tell you in the app or in the store listing before it takes effect, and we will change the effective date above. If you keep using the app after a change takes effect, the new terms apply. If you don't agree, stop using the app and delete it.
10. Ending these terms
You can stop using the app at any time by deleting it. If you seriously or repeatedly break these terms, your licence ends. Sections 4, 5, 11, 12 and 13 continue after these terms end.
11. No warranty
To the fullest extent the law allows, the app and its content are provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We don't promise that the app will always be available, error-free or free of interruptions, or that your progress will never be lost.
12. Limits on our liability
To the fullest extent the law allows, Vykka and its members, staff and suppliers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost data, lost progress or lost profits, arising from your use of the app. Our total liability for any claim relating to the app or these terms is limited to the greater of the amount you paid us for the app in the 12 months before the claim, and US$50.
If you are a consumer in the UK, the EU or another country with consumer protection laws: nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not let us limit or exclude, and nothing in these terms affects your legal rights as a consumer. Sections 11 and 12 apply only as far as your local law allows.
13. Law and disputes
These terms are governed by the laws of the State of Washington, USA, and applicable US federal law, without regard to conflict-of-laws rules. Any dispute will be handled by the state or federal courts located in King County, Washington, and you and we agree to their jurisdiction, except that either of us may bring a claim in a small-claims court that has jurisdiction.
If you are a consumer living outside the United States, you also keep the protection of the mandatory laws of the country where you live, and you may bring a claim in the courts there.
Before going to court, please email hello@storiwick.com and give us 30 days to try to fix the problem.
14. If you got the app from the Apple App Store
These terms are between you and Vykka only, not Apple. Vykka, not Apple, is responsible for the app and its content.
- Your licence is limited to using the app on Apple-branded products you own or control, as the App Store's Usage Rules allow.
- Apple has no obligation to provide maintenance or support for the app.
- If the app fails to meet any warranty that applies by law, you may notify Apple, and Apple will refund the purchase price, if any. To the fullest extent the law allows, Apple has no other warranty obligation for the app. Any other claims, losses, liabilities, damages, costs or expenses caused by a failure to meet a warranty are Vykka's responsibility, as far as these terms do not exclude them.
- Vykka, not Apple, is responsible for handling any claims by you or a third party about the app, including product liability claims, claims that the app fails to meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
- If a third party claims that the app or your use of it infringes their intellectual property, Vykka, not Apple, is responsible for investigating, defending, settling and discharging that claim.
- You confirm that you are not located in a country subject to a US government embargo or designated by the US government as a "terrorist supporting" country, and that you are not on any US government list of prohibited or restricted parties.
- Questions, complaints or claims about the app go to Vykka at hello@storiwick.com.
- Apple and its subsidiaries are third-party beneficiaries of these terms, and once you accept them, Apple has the right to enforce them against you as a third-party beneficiary.
15. If you got the app from Google Play
Google Play's own terms also apply to your download. If those terms conflict with these terms on anything between you and Vykka, these terms apply.
16. Other things
If a court finds part of these terms unenforceable, the rest still applies. If we don't enforce a term straight away, we can still enforce it later. You may not transfer these terms to someone else; we may transfer them to a business that takes over the app. These terms, together with the Privacy Policy, are the whole agreement between you and us about the app.
